Sútikalh. He spoke from his home in Tsal’álh of St’át’imc Territory. Qwalqwálten
has served as the former Chair and Spokesperson for the St'at'imc Chiefs Council
and has also filled the role as elected Chief for Tsal’álh. He described
how the St’át’imc learned yesterday of the decision by the BC Provincial Assessment
Office to cancel the certificate of Al Raine and Nancy Greene-Raine for their
proposed ski resort at Sútikalh (Melvin Creek) in the middle of St’át’imc Territory. <o:p></o:p></span></div>

home of the Winter Spirit, from the proposed development began over twenty
years ago. A small group of St’át’imc people began the work of protecting Sútikalh
with the placement of tobacco into a sacred fire which has been kept burning
since that day.<o:p></o:p></span></div>

spread around the world and as allies and advocates answered the call for
providing support on this critical concern. “After twenty years of extensive
efforts, to the Province of British Columbia and the Canadian Government, we
can only ask why it has taken so long for the message to be heard?” said Qwalqwálten.
In the <i>Declaration of the Lillooet Tribe, May 10, 1911</i>, our St’át’imc Chiefs
stated, "We claim that we are the rightful owners of the territory and
everything pertaining thereto". Our St’át’imc people and leadership have
continuously upheld our unceded title to our territory and this is the basis of
our position in relation to all lands in the territory including Sútikalh.<o:p></o:p></span></div>

Unfortunately, misconceptions and conflicting information threaten to derail this important conversation. Below, we attempt to provide clear, straightforward answers to address some of these fundamental misunderstandings.</div>

<span style="color: #467082; font-size: 15.99px;"> </span>Media outlets across the country have repeatedly reported that First Nations along the pipeline route, including the Wet’suwet’en, have signed agreements in support of the project.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
Underlying this statement are several key issues that require clarification.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
First, the Wet’suwet’en, like many Indigenous groups in Canada, are governed by both a traditional governance system and elected Chiefs and Councils.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
The Chief and Council system exists under the <em>Indian Act,</em> a piece of federal legislation. It was introduced by the federal government in the 19th century as part of Canada’s attempts to systematically oppress and displace Indigenous law and governance.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
The Wet’suwet’en hereditary governance system predates colonization and continues to exist today. The Wet’suwet’en and Gitxsan Hereditary Chiefs, not the <em>Indian Act</em> Chiefs and Councils, were the plaintiffs in the landmark <em>Delgamuukw-Gisday'way</em> Aboriginal title case. They provided the court with exhaustive and detailed evidence of the Wet’suwet’en and Gitxsan governance system and the legal authority of Hereditary Chiefs.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
Unless otherwise authorized by the Indigenous Nation members, the authority of elected Chiefs and Councils is limited to the powers set out under the <em>Indian Act.</em> The <em>Indian Act </em>does not provide authority for a Chief and Council to make decisions about lands beyond the boundaries of the First Nation’s reserves.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
By contrast, the Hereditary Chiefs are responsible under Wet’suwet’en law and governance for making decisions relating to their ancestral lands. It is these lands that the Hereditary Chiefs are seeking to protect from the impacts of the pipeline project, not <em>Indian Act</em> reserve lands.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
Second, Indigenous peoples hold rights to lands in Canada which extend far beyond the boundaries of <em>Indian Act </em>reserves, including Aboriginal title and rights to the lands they used and occupied prior to the arrival of Europeans and the assertion of Crown sovereignty. Aboriginal title and rights are protected under the <em>Constitution Act, 1982</em> – the highest law in Canada’s legal system.</div>
<div style="background-color: white; color: #333333; font-family: Arial, Verdana, sans-serif; font-size: 13px; margin-bottom: 15px; margin-top: 5px; padding: 0px;">
Third, the fact that First Nations have signed agreements with Coastal GasLink does not, in itself, mean that its members support the project without qualification.</div>

Across the country, <em>Indian Act</em> band councils are forced to make difficult choices about how to provide for their members – a situation which exists in large part due to the process of colonization, chronic underfunding for reserve infrastructure and refusal on the part of the Crown to meaningfully recognize Indigenous rights and jurisdiction.</div>

The fact that elected Wet’suwet’en Chiefs and Councils have entered into benefit agreements with Coastal GasLink should not be taken as unconditional support for the project.</div>

Finally, similar to how Canada functions as a confederation with separate provinces with their own authority, First Nation decisions on major projects are not simply a matter of majority rules.</div>

The Quebec provincial government made it clear that it was opposed to and would not sanction the proposed Energy East pipeline. The federal government and other provincial governments respected Quebec’s right to make this decision. Similarly, First Nations often disagree about major projects. One cannot speak for another and the majority cannot simply overrule the minority or individual First Nations.</div>

This document provides a road map to follow, and in particular provides sound legal information on the subject of how the Supreme Court Of Canada (SCC) views Aboriginal Title, how such title is established, and how this title to lands can be continued through the act of possession of the land. Or in other words being on the land implies title to the land, and any claim of ownership of the land by other parties such as the Crown must be proven in law.<br />

Many of the original supporters and founders joined together for a spiritual blessing for the Sutikalh settlement first established in May 2000.</p><p>Filming of the ceremony was not allowed as we gathered around the fire circle that began with several candles that were lighted. Hubie advised that he received another visit from the Olympic Winter Games Security Force and they were making inquiries about the intentions of Sutikalh camp members with regard to protesting the Olympics.<br /><br />Just so there are no mis-understandings, let it be known that the members of the Sutikalh have no intention of setting up an Olympic Games protest in any way shape or form. He had visits from the FBI, CIA, CSIS, MI6 RCMP, and members of The Vancouver City Police Department. Hubie was on a hike up the hill, and when he arrived back at the cabin, members of the Vancouver City Police were in the cabin munching on some pork sandwiches. I was wondering what the VCP did not understand about trespassing on private property. There is a No Trespassing sign displayed at the entrance to the property that only a blind man could miss.<br /><br />You have to wonder what is on the mind of these people considering that the camp is about 80km away from Whistler, and how the camp could pose a risk to the security of the games in any way shape or form. Can you imagine coming home from a hike to find the Police had entered your home, and were eating your food?<br /><br />It was also reported on Global News two weeks ago that you will not be able to drive your car to Whistler unless you can prove that you have a place to park. So imagine if you live in Mount Currie, and have to go to Whistler for a Doctor's or Dentist appointment, and you can't prove that you have a place to park? You will be refused access via a roadblock and asked to turn around period!!! No exceptions. This is madness particularly if you live in the area.<br /><br />VANOC is going out of their way to make vehicle travel in and around the games next to impossible for residents of the Sea To Sky corridor and at an enormous cost to you the taxpayer who is going to have to pay for all of this. <a href="http://www.vancouver2010.com/more-2010-information/local-business--organization-and-resident-information/transportation-plan-and-maps/getting-around-the-sea-to-sky-corridor/">VANOC-Getting Around The Sea To Sky Corridor</a>.<br /><br />Residents may very will have to go over Duffy Lake Road to Lilloet and down the Fraser Canyon in order to get into Vancouver if they need to because vehicle traffic will be restricted during the Winter Games, adding extra time and costs to your trip.<br /><br />The costs of the games are getting out of control, and will provide next to nothing for indeginous people. The games are designed for the rich, and the rich are the only ones who are going to benefit from this madness.<br /><br />As I am writing this I am listening to an interview with <a href="http://www.playthegame.org/knowledge-bank/author-profile/andrew-jennings.html">Andrew Jennings</a>, author of The Great Olympic Swindle, and how he describes the corruption within the IOC. He is in Vancouver today, talking about how the extravagance of all Olympic games leads to the building of massive structures at great expense that will never be used once the games are over. He also says that tourism will also decrease during the Olympics and not increase. He quotes studies that have been done that all the talk about the revenues that are supposed to be brought in by sponsors etc is a myth, it just does not happen, and there are studies to prove this.<br /><br />A sad reality is that The City Of Vancouver is cutting it's operating budget for 2010 and will close down the Blodel Conservatory, and Parks Petting Zoo next year because of a shortfall in funds. I wonder if that has anything to do with the City having to bail out the Olympic Village Project and borrow tens of millions of dollars to guarantee it's completion? This is good news because the river is so close to a dense urban area.<br /><br />However the key point here is an illustration of how development can not only harm the environment, but completely destroy Salmon bearing creeks, streams, and rivers.<br /><br />A ski resort in the Cayoosh would devastate the environment, and have a disastrous effect on the waters that flow down from the Melvin Creek Valley through the watercourses that flow from it.<br /><br />Indigenous Peoples that live in St'at'imc Territory depend upon Salmon as a food source as they have for thousands of years.
